Do you need a solicitor to remortgage?

It depends on what you are doing. If you are staying with your current lender and moving to a new deal (known as a product transfer), no conveyancing work is required and no solicitor is needed.

If you are switching lenders, remortgage conveyancing is required. Your new lender needs to register its charge against your property at the Land Registry, a process that can only be carried out by a qualified solicitor or licensed conveyancer. Remortgage conveyancing requires less work than a full purchase, but it still needs a qualified professional to handle the registration. Your solicitor acts for both you and the lender throughout.


Can you choose your own remortgage solicitor?

Yes, in most cases. Some lenders offer a free conveyancing service as part of their remortgage package, but you are generally not obliged to use it. Choosing your own solicitor means you have a conveyancer whose focus is your interests rather than the lender's.

The most important thing is that your solicitor is on your new lender's approved panel. If they are not, the lender will appoint their own solicitor separately, adding cost and delays to the process. All solicitors on the Homeward Legal panel are approved by all major lenders, so there are no complications on that front.

On searches, your solicitor will advise whether a search indemnity policy or a full search pack is appropriate, depending on your lender's requirements. Some lenders accept indemnity insurance, which is significantly cheaper. We will confirm the most cost-effective route for your remortgaging.

Note that lender charges are separate: your new lender may charge an arrangement charge and your existing lender may charge an early repayment charge. These sit outside the conveyancing costs.

What does a remortgage conveyancing solicitor do?

Once instructed, your solicitor manages the full remortgage from start to finish. Your lender may also arrange a remortgage valuation (sometimes called a mortgage valuation) to confirm the property's current value before issuing the mortgage offer. From there, your solicitor handles:

  • Verifying your identity and carrying out anti-money laundering checks
  • Contacting your existing lender to obtain the redemption figure and retrieve any title deeds
  • Reviewing the mortgage offer and reporting to you on the key terms
  • Ordering searches or arranging indemnity insurance as required by your lender
  • Arranging completion and drawing down funds from the lender
  • Redeeming the existing mortgage and registering the new charge at the Land Registry

Your solicitor will keep you updated throughout and flag anything that needs your attention.


The remortgage conveyancing process

  3. Mortgage offer received: Once your lender issues the formal mortgage offer, your solicitor reviews it and reports to you.
  4. Searches: Your solicitor arranges searches or obtains search indemnity insurance, depending on your lender's requirements.
  5. Redemption figure: Your solicitor requests the settlement figure from your existing lender.
  6. Completion: You sign the new mortgage deed. Your solicitor draws down funds, redeems the old mortgage and pays any remaining balance to you.
  7. Land Registry: Your solicitor registers the new charge at the Land Registry and updates the title register, completing the remortgaging process.
