Conveyancing In Kirkstall Q & A's

Would the fixtures and fittings list items such as free-standing kitchen appliances?

Chiefly, there is no strict definition of fixtures and fittings. The seller and purchaser may unwittingly have completely different views on which items will be sold with the property; this makes resolving any confusion between buyer and seller on this issue so urgent.

I am intending to purchase a church rectory in Goldsborough. Will a chancel search be necessary?

Your lawyer may suggest that a chancel search be ordered, irrespective of the parish in which the property being purchased is located. Through some parish councils have decided to exact chancel repairs on the owners of affected property, there is no way to be certain that a parish where chancel repair fees have not been paid previously will not automatically be the case for future owners.

I am on a short deadline, needing ensure a fast conveyancing transaction, what should we aim for to speed up the transaction?

It is a truism that contacting a proactive and experienced conveyancer is essential to fast conveyancing. There are several tasks you can also do to accelerate the process. These include:

  • ordering a property survey early in the transaction
  • keeping in regular contact with the conveyancer
  • answering any queries raised by your conveyancer as soon as possible

What’s the difference between exchange of contracts and completion?

When you exchange contracts, this means that you are agreeing to all the terms drawn up within the contract made between you on one side of the transaction, and the opposite party on the other side. It is from this point that you are legally obliged to go through with the transaction (unless you want to be subject to financial and/or legal penalties).

The completion of contracts is the point where you officially take over ownership of the property, receive the keys and can move in. All monies are transferred between the various parties and the conveyancing solicitor contacts the Land Registry to register the change of ownership to you.
